The Sept. 1, 2005, decision in ”’Taomae v. Lingle”’ by the Hawaii Supreme Court, invalidates a constitutional amendment passed without a dissenting vote in the Hawaii State Legislature in 2004, and subsequently and overwhelmingly approved by the voters in 2004. This is extraordinarily unfortunate.

First, this is yet another example of a Supreme Court decision undermining the Legislature
